NCHE Brief: Determining Eligibility for McKinney-Vento Rights and Services

Determining eligibility for McKinney-Vento rights and services involves a comprehensive assessment to identify students experiencing homelessness or precarious housing situations. The McKinney-Vento Homeless Assistance Act, a federal law, ensures that homeless children and youth have access to a free and appropriate public education. School personnel, liaisons, and community agencies play critical roles in this process. The first step is to identify homeless students, including those living in shelters, motels, cars, or temporarily staying with others due to loss of housing. Once identified, a thorough evaluation of their living conditions and housing stability is conducted to assess the extent of their homelessness. This includes taking into account factors such as nighttime residence, living arrangements, and the lack of a fixed, regular, and adequate nighttime residence. Through this careful evaluation, eligible students are granted vital rights and services that foster stability, continuity in education, and opportunities for academic success despite the challenges of homelessness.
